Terms of Service
1. Introduction and Acceptance
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Member,” “you,” or “your”) and Consulytica, operated by Consumer Analytics Foundation, a Virginia nonprofit corporation (“Consulytica,” “we,” “us,” or “our”). By accessing or using the Consulytica platform, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Platform. These Terms apply to all visitors, members, and others who access or use the Platform.
2. Description of Services
2.1 The Financial Ascension Program
Consulytica operates the Financial Ascension Program (“C-FAP”), a structured financial development ecosystem designed to provide access to financial tools, resources, and opportunities for individuals who have been traditionally underserved by or excluded from conventional financial systems. The program includes:
- The ProV 24:V3 alternative credit scoring system, which evaluates members on five behavioral pillars: Life Stability, Financial Behavior, Community Engagement, Growth and Progress, and Consistency
- A five-stage progression system (Awareness, Connection, Foundation, Access, and Ascension) through which members advance as their ProV 24:v3 score increases
- Personalized resource matching based on member-provided onboarding information
- Access to the Gabby AI financial co-pilot for personalized guidance
- Educational resources, financial literacy programs, and partner organization connections
- Microgrant opportunities that become available as members advance through program stages
- Integration with FinCliq, our buy now pay later payment infrastructure
2.2 Alternative Credit Bureau Functions
Consulytica operates as an alternative consumer reporting agency. The ProV 24:V3 score is not a traditional FICO or VantageScore credit score. It is a proprietary behavioral assessment designed to recognize financial responsibility and community engagement beyond what traditional credit systems measure. Consulytica is not affiliated with Equifax, Experian, or TransUnion.
Your ProV 24:V3 score may be shared with authorized partner organizations, merchants, and FinCliq for the purposes of determining program eligibility, purchasing power, and access to opportunities within the Consulytica ecosystem. This sharing is governed by our Privacy Policy and applicable data sharing agreements.
2.3 Gabby AI Co-Pilot
Gabby is an artificial intelligence-powered financial and life support co-pilot that provides personalized guidance based on your profile data. Gabby’s responses are generated using AI and are intended for informational and educational purposes only. Gabby’s guidance does not constitute financial, legal, medical, or professional advice. You should consult qualified professionals before making significant financial decisions.
3. Membership and Eligibility
3.1 Eligibility Requirements
To use the Platform, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Provide accurate, complete, and current information during registration
- Have the legal capacity to enter into a binding agreement
- Not have been previously suspended or removed from the Platform
3.2 Account Registration
You must create an account to access most Platform features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Consulytica of any unauthorized use of your account or any other security breach.
You agree to provide accurate and complete information in your onboarding questionnaire, including your living situation, income source, financial challenges, and goals. This information is used to personalize your program experience and resource matching. Providing false information may result in account suspension.
3.3 Account Verification
Certain program benefits require document verification conducted by Consulytica Verification Services (CVS). Verified status for housing, employment, and income requires submission of qualifying documents for review. Annual re-verification is required for certain document types. Consulytica reserves the right to request additional documentation and to remove verified status if documentation cannot be renewed or is found to be inaccurate.
4. The ProV 24:V3 Scoring System
4.1 How Your Score is Calculated
Your ProV 24:V3 score is calculated daily based on data from multiple sources including your platform activity, verified documents, bank account data (if connected), payment history through FinCliq, and reports from authorized partner organizations. The score ranges from 0 to 1,000 and reflects five behavioral pillars weighted as follows:
- Life Stability: 25% (up to 250 points) — housing, employment, banking, food security
- Financial Behavior: 25% (up to 250 points) — payment history, bank signals, income consistency
- Community Engagement: 20% (up to 200 points) — program participation, events, mentorship
- Growth and Progress: 20% (up to 200 points) — education completions, milestones, stage advancement
- Consistency: 10% (up to 100 points) — sustained positive behavior over time
4.2 Score Factors
Your score is subject to time-based weighting factors including account age multipliers that give greater weight to established behavioral patterns, payment recency weighting that considers how recent positive and negative activity is, and thin-file dampening for accounts with limited payment history. These factors are designed to accurately reflect your current financial behavior and are consistent with sound alternative credit assessment principles.
4.3 Score Changes
Your score may increase or decrease based on new activity, the passage of time, changes in your bank account data, updated document verification status, or reports from partner organizations. Score changes are calculated during regular scoring runs. We do not guarantee a specific score or score trajectory. No specific action is guaranteed to produce a specific score outcome.
4.4 Dispute Rights
You have the right to dispute information in your Consulytica profile that you believe is inaccurate. Disputes may be filed through the credit report section of the Platform. Consulytica Verification Services will review your dispute and notify you of the outcome. If a dispute is resolved in your favor, the disputed item will be removed from your profile and your score will be recalculated. You may re-dispute matters if you have additional documentation to support your claim.
5. Bank Account Connection and Financial Data
5.1 Stripe Financial Connections
With your explicit consent, you may connect your bank account to the Platform using Stripe Financial Connections, a secure third-party bank linking service. By connecting your bank account, you authorize Consulytica to access read-only data including your account balance, transaction history for the prior 90 days, account ownership information, and deposit patterns.
Bank data is used to calculate your Financial Behavior pillar signals including balance stability, income consistency, overdraft patterns, and deposit cadence. This data is refreshed periodically and helps provide a more accurate picture of your financial health.
5.2 Data You Authorize Us to Access
By connecting your bank account, you specifically authorize access to:
- Current and historical account balances
- Transaction descriptions, amounts, and dates for the prior 90-180 days
- Account ownership and holder information
- Deposit timing and frequency patterns
5.3 What We Do Not Access
We do not access, store, or use your full bank account numbers, routing numbers, login credentials, or any ability to initiate transactions. Bank connections are read-only. Stripe Financial Connections maintains its own terms of service and privacy policy, available at stripe.com.
6. FinCliq Pay Later
6.1 FinCliq Integration
FinCliq is a buy now pay later payment infrastructure that is integrated with the Consulytica platform. FinCliq is a separate legal entity from Consulytica. Your access to FinCliq purchasing power is determined by your ProV 24:V3 score stage. FinCliq transactions are subject to separate FinCliq terms and conditions which you must agree to when accessing FinCliq features.
6.2 Interest-Free Payments
All FinCliq buy now pay later purchases available through the Consulytica platform are interest-free. No interest is charged on any FinCliq installment plan available through this program. FinCliq does not charge prepayment penalties.
6.3 Payment Reporting
On-time and missed payments on FinCliq installment plans are reported to Consulytica and factored into your ProV 24:V3 score, specifically within the Financial Behavior pillar. This reporting functions similarly to how traditional credit accounts report to credit bureaus. Consistent on-time payments over time contribute positively to your score. Missed payments negatively affect your Financial Behavior pillar.
6.4 FinCliq Access Tiers
Your FinCliq spending access is tiered based on your current ProV 24:V3 score stage:
- Stage 1 (Awareness, 0-250): No FinCliq access
- Stage 2 (Connection, 251-400): Up to $150 in pay later purchasing power
- Stage 3 (Foundation, 401-600): Up to $500 in pay later purchasing power with installment options
- Stage 4 (Access, 601-800): Up to $2,000 in pay later purchasing power
- Stage 5 (Ascension, 801-1,000): Up to $2,000 in pay later purchasing power plus store credit options
These limits are subject to change. FinCliq reserves the right to approve or decline individual transactions based on its own risk assessment criteria in addition to your ProV 24:V3 score tier.
7. Partner Organizations and Merchants
7.1 Partner Network
Consulytica partners with nonprofit organizations, workforce development programs, educational institutions, financial institutions, and merchants (collectively, “Partners”) to deliver program benefits and opportunities. Partners may report eligible events to your Consulytica profile including program enrollments, employment placements, grant awards, and payment history. Partner reporting is subject to data sharing agreements between Consulytica and each Partner.
7.2 Merchant Access
Partner merchants in the Consulytica network may offer special programs, flexible payment options, and promotions based on your ProV 24:V3 score stage. Access to merchant benefits is contingent on maintaining eligibility requirements and is subject to merchant-specific terms and conditions. Consulytica does not guarantee the availability of any specific merchant offer or promotion.
7.3 Partner Grant Reporting
Partner organizations may report grants, scholarships, or financial assistance they award to Consulytica members. These reports are displayed on your credit profile as a record of financial assistance received and community investment. Grant information does not directly affect your ProV 24:V3 score but may affect your eligibility for certain program opportunities.
8. Microgrants
8.1 Microgrant Eligibility
Microgrant opportunities become available as members advance through the Financial Ascension Program stages. Eligibility for specific microgrants is subject to program criteria that may include stage requirements, verified profile completeness, program participation, and availability of funds.
8.2 No Repayment Required
Consulytica microgrants are not loans. Microgrant funds are provided as direct financial assistance and are not subject to repayment under any circumstances. Receipt of a microgrant does not create a debt obligation to Consulytica.
8.3 Use of Funds
Microgrant funds are provided to support members’ financial stability and development goals. While specific use restrictions may apply to individual grant programs and will be disclosed at the time of award, Consulytica does not track or audit the specific use of general microgrant funds.
9. Member Conduct and Prohibited Activities
By using the Platform, you agree not to:
- Provide false, misleading, or fraudulent information including false documentation for verification purposes
- Attempt to manipulate, game, or artificially inflate your ProV 24:V3 score
- Use the Platform for any unlawful purpose or in violation of applicable law
- Interfere with or disrupt the Platform or servers or networks connected to the Platform
- Attempt to gain unauthorized access to any portion of the Platform or any other systems
- Use the Platform to harass, threaten, or harm other members or staff
- Impersonate any person or entity or falsely state your affiliation with any person or entity
- Use automated scripts or bots to access the Platform
- Sell, transfer, or assign your Consulytica membership or account to another person
Violation of these prohibitions may result in immediate account suspension or termination, removal of verified status, score adjustments, and potential referral to law enforcement where appropriate.
10. Intellectual Property
The Platform and its original content, features, and functionality are owned by Consumer Analytics Foundation and are protected by applicable copyright, trademark, and other intellectual property laws. The ProV 24:V3 scoring methodology, the Financial Ascension Program structure, and associated proprietary systems are the intellectual property of Consulytica.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Platform content without prior written consent from Consulytica.
11. Privacy and Data
Your privacy is important to us. Our collection, use, and sharing of your personal and financial information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.
12. Disclaimers
12.1 No Financial Advice
The Platform, including Gabby and all program content, provides general educational and informational content only. Nothing on the Platform constitutes financial, legal, tax, or professional advice. You should consult qualified professionals before making financial decisions.
12.2 No Guarantees
Consulytica does not guarantee that use of the Platform will improve your financial situation, result in specific score outcomes, qualify you for any particular benefit, or lead to any specific financial result. Program benefits are subject to availability, eligibility requirements, and partner participation.
12.3 Platform Availability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CONSULYTICA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONSULYTICA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF CONSULYTICA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CONSULYTICA’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO CONSULYTICA IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) $100.
14. Indemnification
You agree to indemnify, defend, and hold harmless Consulytica and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your use of the Platform.
15. Termination
15.1 Termination by You
You may terminate your account at any time by contacting Consulytica at info@consulytica.com. Termination of your account will result in deletion of your profile data in accordance with our Privacy Policy and data retention schedule.
15.2 Termination by Consulytica
Consulytica may suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms, providing false information, suspected fraud, or program ineligibility. Upon termination, your right to access the Platform immediately ceases.
16. Dispute Resolution and Arbitration
16.1 Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Richmond, Virginia for any actions not subject to arbitration.
16.2 Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Richmond, Virginia. Judgment on the award may be entered in any court with jurisdiction.
16.3 Class Action Waiver
YOU AND CONSULYTICA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
16.4 Exception — Small Claims
Notwithstanding the arbitration agreement, either party may bring an individual action in small claims court in Richmond, Virginia if the claim qualifies.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy, Credit Reporting Disclosure, and any applicable FinCliq terms, constitute the entire agreement between you and Consulytica regarding the Platform and supersede all prior agreements.
17.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Consulytica’s failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
17.4 Changes to Terms
Consulytica reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the Effective Date. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
